Man's mental health keeps trial on hold

May 03--A man accused of shooting at deputies in 2015 is, almost two years later, still not capable of proceeding to trial, a judge ruled Tuesday.

Malcolm Lynn Andrews, 48, exchanged gunfire with Caldwell County Sheriff's Office deputies in May 2015 after barricading himself in his uncle's home during a standoff in the Globe area that lasted nearly 24 hours.

His uncle, James B. Andrews, said at the time that Andrew hadn't taken medication he needs.

"Next thing I know, he went plumb wild," Andrews said at the time.

After more than a year of treatment at Broughton Hospital, a state-run mental hospital in Morganton, Andrews was charged with assault on officers with a firearm and possession of a firearm by a felon. But after arriving at the Caldwell County Jail late last summer, he stopped taking some of his medications, and in December 2016 he was transferred to Central Prison in Raleigh.

According to court records, Andrews has been diagnosed with schizoaffective disorder and refuses to take medications as prescribed when not under court-ordered committment to a mental health facility.

Judge Daniel Kuehnert ruled Tuesday that Andrews is incapable of proceeding to trial at this time. He will be transferred to Broughton for further treatment. His case is still pending.
